The Court held that the dispute is a claim to specific shares and, on the evidence, the 200 million Mayer HK shares had a value comfortably in excess of HK$1,000,000 so an appeal to the Court of Final Appeal lies as of right under s22(1)(a); however the appellant's proposed appeal lacked reasonable prospects of success on the merits and a full stay was refused, with only a limited interim stay granted conditional on an application to a single judge of the Court of Final Appeal and security being provided.
