The court held that the respondent had failed to comply with the lump sum obligation for an extended period (3 years 10 months) and that her 2021 summons had no legal basis because the court cannot vary lump sum commitments or voluntary promises affecting third parties under s11 Cap.192; therefore the respondent must pay the applicant's costs of the two summonses including reserved costs.
