The court held that, although the trial judge made a minor misdirection by stating lies amounted to evidence of guilt, the misdirection was not material in context; the combination of possession of stolen property, voluntary confession statements, the presence of the co‑offender's details in the applicant's notebook and the applicant's unsatisfactory explanations constituted overwhelming evidence; therefore the convictions were safe and leave to appeal was refused.
