The magistrate's disbelief of the appellant's uncontradicted account was based in part on speculative personal impressions about discounts in legal goods rather than on evidence; because the Crown did not substantively support the conviction and the presumption under Section 46 was not properly maintained on evidence, the conviction for trafficking was set aside and substituted with a conviction for simple possession and the sentence reduced to nine months' imprisonment.
