On the balance of probabilities the court preferred the Plaintiff's evidence supported by contemporaneous documents and found the monies were loans advanced to the 1st Defendant with agreed interest; Plaintiff was also entitled to a one-third share of profit as remuneration excluding losses in preceding or subsequent tax years; quantum against the 2nd Defendant assessed at a lump sum of $500,000 due to unreliable accounts.
