The Court held that the appellants had no defence on the facts or in law: the 2nd defendant changed instructions and disposed of proceeds, there was no evidence of creditor bad faith, concealment, connivance or prejudicial variation, and therefore the Order 14 judgment against the principal debtor and guarantors was properly entered and must be affirmed.
