Section 6(3) of the Theft Ordinance renders money received on account of the creditor as belonging to that creditor; the magistrate's factual finding that the appellant received the sums and did not pay them into CB's account was supported by the evidence and the appeal against conviction was therefore dismissed; the sentence of five months' imprisonment was varied to a suspension for three years and compensation ordered.
