The trial judge was entitled to accept the applicant's spontaneous admission that he was 'conveying some people' together with the surrounding circumstances (his position on the sampan and the presence of his brothers manning the vessel) as meaning he was acting as crew; there was ample evidence to support conviction and the application for leave to appeal was dismissed.
