The court held that a cross-appeal does not automatically fall away upon withdrawal of the primary appeal where the cross-appeal has been properly brought and the other party has notice; the contractual interest at 40% applied up to the date of judgment and thereafter interest merged into judgment so the judgment rate (8.125%) applied until full payment absent an express contractual provision to the contrary; costs were awarded to P to be summarily assessed on an indemnity basis.
