The Court held that the trial judge erred in refusing leave under s.154 because the proposed cross-examination was relevant and might have led the jury to a different view, and that the prosecution evidence was insufficient to prove penetration beyond reasonable doubt; accordingly the conviction was unsafe and was quashed and the sentence set aside.
