The Court implied a term from the currency endorsement that payments were payable by bankers' drafts on Toronto in Canadian dollars so the debt's primary place of payment and hence its situs was Toronto (the debtor's head office residence); accordingly the proceeds were property situate outside the Colony and excluded from estate duty under s.10(1)(b).
