On the balance of probabilities the court found Hong of Fu Ming first designed and supplied the OK Angle Beads from 2000-2001 and the Defendant knew of the Plaintiffs' long-standing supply and trade in those beads; the Defendant applied for the Suit Mark with the intention of targeting competitors and obtaining a monopoly in Hong Kong, conduct falling short of acceptable commercial behaviour and therefore made in bad faith under s 11(5)(b) TMO; accordingly the Suit Mark registration is invalidated.
