There was no binding concluded agreement in 1946 not to change the building name; however the defendant's unilateral change of the building name materially risked and in fact disrupted the plaintiff's enjoyment of the demised offices (by endangering mail delivery intrinsic to office use), thereby breaching the covenant for quiet enjoyment; plaintiff was entitled to recover provable mitigation costs of $34,359.10 but failed to prove loss of goodwill.
