Given the consent order declaring termination and ordering vacation of the registration with damages to be assessed, the appellant's refusal or delay to vacate the registered memorial constituted a breach which caused the second purchaser to refuse completion; consequential damages (including the double deposit and agent fees paid in relation to the aborted second sale) were properly recoverable and the appeal dismisses challenges to the assessment.
