Where parties have agreed a commencement date for the new tenancy, and absent any contrary agreement, the fair market rent under Part IV must be fixed as at that agreed commencement date rather than the date of hearing; Sections 115 and 119I support measuring fair market rent by reference to the terms (including commencement date) of the new tenancy.
