Joinder was refused and the Master's decision affirmed because the proposed 2nd plaintiff (Yung) had already commenced separate proceedings in respect of the identical HK$100,000 claim; permitting joinder would create duplicity of proceedings and only Yung could elect where to pursue her claim; therefore Cheung's joinder application was misconceived.
