On the balance of probabilities the plaintiff proved she solely funded the acquisition and maintenance of the Property through contemporaneous bank evidence and loans, supported by a signed 16 February 2012 acknowledgement by the 1st defendant; the defendants failed to provide particularised or documentary rebuttal, the 2nd defendant was debarred from adducing evidence, and the deceased 1st defendant's statements, being untested by cross‑examination, were not given weight; accordingly the court declared the plaintiff beneficial owner and granted judgment for the plaintiff.
