The debarring Order was set aside because it rested on an alleged finding of mental incapacity without following the mandatory Mental Health Ordinance procedures and Order 80 cannot be used independently to debar a litigant; further, abuse-of-process debarment required compliance with section 27 High Court Ordinance which was not followed; consequentially the striking out by Keith JA based on that Order was also set aside.
