The court accepted the administratrix's evidence (including admissible hearsay under s49(2)) and documentary corroboration that the parties agreed beneficial ownership of Ricco was 85% to the deceased and 15% to Madam Lui; notwithstanding the 2007 allotment was declared void, equity demands recognition of that beneficial ownership and the court therefore declared the 85/15 beneficial split, ordered transfer of 1,050,000 shares to the administratrix, and ordered an account of dividends/profits with interest and costs.
