On the evidence the court found the Mother/Wing Cheong paid the purchase/down payments and was the beneficial owner; documentary HP agreements, KLM certificates and the Redeem Cheque deposit into the joint account corroborated that in December 1992 legal and beneficial ownership passed to the defendant who financed the balance by a 1992 HP loan and later replaced the vehicle; plaintiff was an unreliable witness and failed to prove beneficial ownership or quantum of loss; accordingly her claims fail and must be dismissed.
