The service lane, although privately owned, has a public character by reason of its function and governmental interest in preserving it; as a result the lane divides the land into two sites for the purposes of plot ratio/site coverage and the Building Authority was entitled to require modification under s.42 and impose conditions (diversion lanes/pavements) and accordingly the Court of Appeal allowed the appeal and set aside the trial judge's order.
