The Court of Appeal upheld the judge below: the arbitrator did not err in law in finding the Deed and Undertaking obligated Swire to procure surrender of 1,974,000 sq ft of commercial GFA and that the reduced commercial limit took effect on the agreement in 1986; Swire failed to demonstrate a plain legal error or a very strongly arguable point and had raised a new, unarguable contention which had not been advanced at arbitration, therefore leave to appeal was properly refused and the appeal dismissed.
