The application for leave out of time was dismissed because time runs from the date of judgment, the defendant's two‑day delay was inexcusable, the defendant failed to demonstrate a real or reasonable prospect of success on the merits, the defendant's absence at trial was unjustified so the trial and findings were valid, the District Court had jurisdiction to hear the claim, and there was no basis to vary the costs order nisi which was correctly made absolute with costs to follow the event.
