The communications (two letters and an email) were inaccurate and misleading in material respects, designed to attract business by frightening off customers of Toto Toys and thus amounted to unlawful interference with Toto Toys' trade; there was a serious question to be tried, damages were inadequate and the balance favoured granting an interlocutory injunction restraining the 1st plaintiff from publishing the impugned words.
