Leave to appeal was refused because the respondent failed to demonstrate a reasonable prospect of success: he did not defend the Lands Tribunal proceeding, failed to comply with the relief-from-forfeiture conditions by the relief deadline (including non-payment of HK$800 costs), and could not rely on non-receipt of the sealed order given service was at the lease address and he had chosen not to reside there; accordingly no stay of execution was warranted.
