There existed genuine disputes over the construction of the defects clause and the accuracy of the architect's list of defects which were expressly agreed by the parties to be referred to arbitration; accordingly the court could not properly grant summary judgment and in the exercise of its discretion under the Arbitration Ordinance must stay the actions in favour of arbitration; external works were held to remain part of the main contract and thus also subject to arbitration.
