Magistrate's credibility findings of the customs officers were rational and not vitiated by error; on the accepted facts the prosecution proved the offence beyond reasonable doubt; the evidence did not suffice to raise the s26 statutory defence; and the 10‑week immediate custodial sentence was not wrong in principle nor manifestly excessive given the deterrent objective and harm to Hong Kong's reputation.
