Convictions on charges 4, 7, 8 and 9 were quashed because Crown failed to prove deception was the operative cause of transfer of goods (cheques relied on were shown by Crown evidence to have been given after property had passed) and no evidence established the company's authority to accept the substitute cheque (so no proved deferment by company). Convictions on the other charges (notably 5 and 6) were upheld because evidence established appellant acted as proprietor and knowingly represented ability to pay despite insufficient funds, thereby obtaining goods by deception.
