The court held that it is not necessary for drawings as defined by s.48(1) to possess an element of artistry to satisfy s.3(1)(a); drawings (including diagrams, plans and technical drawings) are protected irrespective of artistic quality and therefore the magistrate was wrong to require proof of artistic merit before finding copyright.
