The appeal is dismissed because the appellant failed to provide a satisfactory, particular explanation for the delay in seeking to set aside a regular default judgment and failed to show any arguable or triable defence: there was no satisfactory evidence that notice limiting the guarantees was given, no sustainable basis for a fiduciary relationship, and no established duty of care by the bank to explain standard guarantees to an experienced businessman; therefore the trial judge correctly exercised his discretion to refuse to set aside the judgment.
