The Court refused leave to appeal because the judge's refusal to admit the late medical expert report was a bona fide exercise of case management discretion, not plainly wrong: the judge had considered probative value but was entitled to refuse admission given the plaintiff's unexplained delay, the coercive effect of the Unless Order, the real risk of the trial over-running and the possibility of unfair disruption to case management.
