The court granted an interim stay because the leave application would likely be rendered nugatory absent a stay given the realistic risk of asset dissipation (including access requests by companies associated with the defendant and recent transfers of shares), at least one ground of appeal appeared to have arguable prospects, and any prejudice to the defendant would be short-lived because the stay is interim pending a prompt paper disposal of the leave application.

No real risk of compromised independence was shown: HKC would be a factual witness and exposed to cross-examination regardless of KCHF acting; there was no evidence KCHF had done or would do anything improper; the defendant's long and inexcusable delay further disentitled him to injunctive relief; plaintiff's right to choose counsel prevailed. Accordingly the application to restrain KCHF (in substance to restrain plaintiff from retaining them) was dismissed and costs awarded to plaintiff assessed at HK$150,000.
