The Court found the magistrate's conclusion that the respondent was not acting in concert was wrong and that the original sentence was manifestly inadequate; having regard to the respondent's prior convictions and culpability the appropriate immediate custodial sentence was greater than the fine imposed, but factoring in delay and payment of compensation the sentence on review was an immediate three months' imprisonment with the fine remitted and the compensation upheld.
