The claim is dismissed because the applicant failed to prove that the 2nd alleged accident occurred in the course of employment: contemporaneous evidence (timecards, hospital records), long delay in reporting, inconsistent statements and credibility findings favored the respondent; medical evidence indicated only recurrence or a mild sprain attributable mainly to the 1st accident, so even if liability were assumed the MAB assessment overstated permanent loss and the court would limit loss attributable to the 2nd event to about 2–3%.
