    The Court of Appeal held the trial judge was wrong to treat the payments to Madam Ho as returns on her investment in the company because audited company accounts did not support the inference of company distributions, there was no evidence of implementation of the alleged arrangement or of distributions channeled through the deceased, and the evidence supported that the deceased treated Madam Ho as a dependant. The appeal was allowed and an award of HK$2,625,000 was ordered under s.3(1)(ix).
