Appeal allowed and the Master’s conditional order set aside because the Default Judgment was irregular: plaintiff failed to give credit for the deposit (deeming provision) such that at the date of the statutory demands there was no debt; irregularity justified unconditional setting aside of the Default Judgment and extension of time to appeal.

No renewal agreement was proved on the balance of probabilities; tenant validly returned vacant possession on 14 May 2014 because it gave notice and took reasonable steps to notify landlord and had no intention to retain possession; tenant liable for interim rent, management fee and rates for 7–14 May 2014 and for proven lighting damages; landlord entitled to deduct these sums from the security deposit and return the balance; no order for costs.

The court accepted the plaintiff's assessment: loss of rental and service charges from 26 November 2006 to 15 November 2007 amounted to $397,698.99, deducted the deposit of $101,684.40 leaving $296,014.59, awarded contractual interest on rent and service charges for the period at 3% over the bank's best lending rate and allowed costs of $33,500.
