The Court found that the Pilot judgment monies were not ordinary company assets but were held by Leason as trustee/bailee for the two shareholders in respect of the four machines each owned by them; accordingly Sivan is entitled to account and payment of 45% of the Pilot monies received by Leason, and Kwok must account; locus was established and the Companies Ordinance arguments did not defeat the beneficial claim.
