- LAM SIU LEUNG AND ANOTHER v. KOOVER WOOLLEN KNITTING FACTORY LTD. AND OTHERS
- Court
- Court of First Instance
- Case number
- HCMP6321/1998
Court found the company and Yuen group conducted affairs in a manner unfairly prejudicial to petitioners by selectively prosecuting claims and by failing to pursue known misappropriations and by treating Tong differently to petitioners; petitioners were not guilty of misconduct disentitling them to relief; appropriate remedy is to order the Yuen group (Yeung and elder Mr Yuen) to purchase petitioners' shares at a fair value assessed by an accountant (or appointed by the court) and to dismiss the petition as against Hoover and China Woollen.
