Although the sentencing judge erred in principle by adopting an unduly low starting point and over‑relying on rehabilitation, the Court of Appeal dismissed the review because, given the respondent's substantial time already served in custody and the delay in the review process, substituting a term of imprisonment would now be intrinsically unjust; accordingly the training centre order was left intact.
