The receipts given by the 1st defendant unequivocally recognized the plaintiff's ownership and granted the plaintiff an unconditional right to collect the moulds without additional terms; evidence of trade usage was insufficient, unparticularised and inconsistent with the written receipts, and the 1st defendant failed to identify which moulds related to any outstanding assignment or sums. Consequently no lien existed and the plaintiff was entitled to return of the moulds and repayment of the money paid into court.
