The court assumed for present purposes the validity of the s13E(1) orders and, having balanced the public interest in securing important Crown witnesses for an ongoing major murder trial against the respondents' interest in repatriation and the conditions of detention, concluded that detention under s32(4)(b) should be ordered for all respondents except three for a limited period (14 days from 3 December 1993) to preserve the status quo pending fuller consideration of jurisdictional and factual issues; procedural non‑compliance (unsealed notices) did not defeat the applications.
