The Court held the Magistrate did not err: having regard to the appellant's prior record, breaches of probation, triad association, detailed reports and the Young Offender Assessment Panel recommendation, the statutory test under s4 was met and a Training Centre Order was appropriate; adult authorities cited were inapplicable, therefore the appeal was dismissed.

Although the trial Judge could prioritize rehabilitation under s.109A at the time, the conspiracy to kidnap was sufficiently grave, the respondent showed little remorse and the Detention Centre order was manifestly too lenient; the Court allowed the review, set aside the Detention Centre order and substituted an order under the Training Centre Ordinance.

Section 4(4) of the Detention Centres Ordinance must be given its plain meaning: a detention order cannot be made unless the Commissioner has informed the court that the young offender is suitable for detention and that a place is available; in the absence of such an affirmative opinion the magistrate's Detention Centre order was invalid and a Training Centre order was substituted.
