The amended s.2 of the Offences Against the Person Ordinance applies retrospectively pursuant to Article 12 of the Bill of Rights Ordinance (per R v Lam Ka-yiu), permitting resentencing of an offender who was under 18 at the time of the offence; the jury verdict of murder was supported by the evidence and the Court substituted a determinate sentence of 29 years for the original life sentence.
