Leave to appeal was refused because the contested legal questions were either purely factual or not reasonably arguable in this case; in any event the estoppel defence — based on the wife's knowledge of the proposed sale, failure to speak for a prolonged period (27 months) and facts showing she was estopped from asserting a proprietary claim against the purchaser — would defeat her appeal; the court applied relevant authority on detriment and constructive trusts and concluded the issues did not merit certification to the Court of Final Appeal.
