By a majority the Court held the Medical Council’s finding that Dr Fung did not make a diagnosis of acute bronchiolitis was open to the Council on the evidence (contemporaneous records and expert testimony); because the Council concluded the patient did not have acute bronchiolitis it followed that the prescription of steroids was unjustified and the findings of professional misconduct and concurrent removal orders were upheld and the appeal dismissed with costs.
