The Court found the primary judge's reasons on balance of convenience deficient and, on reassessment with evidence and undertakings available on appeal, concluded that discharging the interlocutory injunction on the defendants' undertaking to confine Hong Kong operations to the IFC tea salon better preserved the respective interests; accordingly the injunction was set aside and discharged on that undertaking.
