The Full Court held that the jury were entitled to reject Major Green's psychiatric evidence as open to criticism and that there was no misdirection by the judge in relation to absence of Crown medical rebuttal; the appeal was dismissed and the murder conviction upheld. The court declined to lay down a rule that abnormality under s.3 requires permanent organic brain injury.
