The Court dismissed the appeal: the plaintiff failed the comparator question under s6(a)/s8 because a person without disability but performing equally poorly would have been treated the same; the employer established the s12(2)(i) defence (plaintiff unable to carry out inherent AO requirements without extraordinary, non‑viable accommodation); there was no harassment; accordingly appeal dismissed with costs.
