The High Court affirmed that the court may exercise its discretion under s65 to order the employer company to pay unpaid adjudicated sums despite claims of financial difficulty, particularly where the company had prioritized other payments and there was evidence it had funds at times; however, the court must consider individual circumstances of a director when ordering personal liability and, on the facts, the director's limited means, health and role justified setting aside the order against him while maintaining the order against the company.
