Absent fraud, and having regard to substantial and inexcusable delay, lawful service, directors' abandonment and the absence of any legal effect from an unsatisfied proof of debt, the court exercises its discretion to refuse to re-open the foreclosure order absolute; accordingly the mortgage cannot be redeemed and the Plaintiff's claim is dismissed.
